Terms of Service

Effective Date: March 30, 2026

These Terms of Service (“Terms”) govern your use of the Pace mobile application and related services (the “Service”) operated by Applied AI LLC (“we,” “our,” or “Pace”). By creating an account or using the Service, you agree to these Terms.

1. Description of Service

Pace is a fitness accountability platform that groups users into small teams (“Squads”) of up to 5 members. Users complete weekly check-ins, receive AI-generated coaching responses, and participate in team-based accountability. Additional features include Clubs (community-level groups), HealthOS (nutrition and workout tracking), and a human coach marketplace.

2. Accounts

You must be at least 13 years old to use Pace. You are responsible for maintaining the security of your account credentials. You agree to provide accurate information during registration and to keep your account information current.

You may not create accounts for the purpose of abusing the Service, impersonating others, or circumventing enforcement actions.

3. Subscriptions and Billing

Free Tier

Pace offers a free tier with limited features. Free users can join one Squad and complete weekly check-ins.

Paid Tiers

Paid subscriptions (Team, Coached) unlock additional features including AI coaching, streak tracking, and advanced analytics. Prices are displayed at the time of purchase and may be updated with notice.

Free Trial

New users receive a 14-day free trial on paid tiers. No credit card is required to start a trial. At the end of the trial, you will be prompted to subscribe. If you do not subscribe, your account will revert to the Free tier with all data preserved.

Billing

Subscriptions are billed monthly or annually through Stripe. You can cancel at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.

Club Subscriptions

Club organizers pay a separate subscription for club infrastructure. Club members pay their own individual Pace tiers independently.

4. User Content

You retain ownership of content you submit to the Service, including check-in responses, profile information, Team Feed posts, and progress photos (“User Content”). By submitting User Content, you grant us a limited license to store, process, and display it as necessary to operate the Service.

Check-in free-text responses are private to you and your AI coach. Only the “message for your team” field is shared with Squad members via the Team Feed. Club organizers cannot see individual check-in content.

5. AI Coaching

AI coaching responses are generated by artificial intelligence and are intended for motivational and accountability purposes only. They do not constitute medical, nutritional, or professional fitness advice. Always consult a qualified professional before making changes to your health or fitness routine.

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Harass, bully, or intimidate other users
• Submit content that is abusive, hateful, or contains profanity directed at other users
• Impersonate another person or misrepresent your identity
• Attempt to access another user's account or data
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools to access the Service without authorization
• Scrape, collect, or harvest user data

We reserve the right to suspend or terminate accounts that violate these Terms without prior notice.

7. Intellectual Property

The Pace name, logo, design elements, and software are the intellectual property of Applied AI LLC. You may not copy, modify, distribute, or create derivative works from our intellectual property without written permission.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that AI coaching responses will be accurate or appropriate for your situation.

Pace is not a medical device. HealthOS nutritional and fitness recommendations are generated by AI and should not replace professional medical advice.

9. Limitation of Liability

To the maximum extent permitted by law, Applied AI LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

10. Termination

You may delete your account at any time through Settings > Account > Delete Account. We may terminate or suspend your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately and your data will be deleted per our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notification or email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
